North America's Landfill Squeeze Is Making the Case for Waste-to-Energy

Americans recycle less than they think they do, and the country is running out of places to put what doesn't get recycled. Those two facts are connected, and together they explain why waste-to-energy is moving from a niche technology to a serious part of the conversation about municipal solid waste (MSW) in North America.

The recycling numbers don't match the story

Survey after survey finds that most Americans believe recycling works. Keep America Beautiful research shows 87% of people say recycling is important, and 62% grade their own habits an A or B. The actual numbers tell a different story. The national MSW recycling and composting rate sits around 35%, a figure that has barely moved in a decade. Plastic is worse: the recycling rate for plastic has been cut roughly in half since 2014, from about 9.5% down to 5-6% today, according to industry data compiled by the American Chemical Society's C&EN. Only about a fifth of the most common plastic packaging — bottles, jugs, tubs, caps — is actually recyclable in practice, regardless of what the label says.

Part of this is confusion. Recycling rules vary by city and even by hauler, and a Keep America Beautiful survey found most people fail basic quizzes on what belongs in the bin. Part of it is economics. When China stopped accepting most foreign recyclables in 2018, it removed the buyer that had absorbed a huge share of U.S. curbside material. Domestic reprocessing capacity never fully replaced that market, so a meaningful chunk of what households sort into recycling bins still ends up landfilled or incinerated anyway.

Landfills are shrinking on a fixed timeline

The other half of the problem is physical space. The U.S. waste industry has an average of about 18 years of remaining landfill capacity, and total capacity is projected to drop more than 15% over the next five years, per reporting from Waste Dive and the SWEEP Standard. The EPA maintains that national capacity is adequate for now, but that average hides real regional strain — the Northeast in particular is running short, and permitting a new landfill takes years and draws fierce local opposition almost everywhere. Fewer new sites are opening than old ones are closing. That combination pushes disposal costs up and pushes waste managers toward alternatives that don't require finding, permitting, and defending new holes in the ground.

Waste-to-energy is one of those alternatives, and it already has a track record in the U.S. There are 85 WTE facilities operating across 23 states, processing more than 30 million tons of trash a year, according to EIA and industry tracking. Those plants sell more than 14.5 million megawatt-hours of electricity to the grid annually, recover over 730,000 tons of ferrous metal for recycling, and reduce the volume of the waste they process by about 87% — turning roughly 2,000 pounds of garbage into 300 to 600 pounds of ash. Florida, which has 12 WTE facilities, is the clearest example of a state that has built disposal infrastructure around the technology rather than around ever-expanding landfills.

Policy is starting to catch up

States are also starting to shift the cost of packaging waste back onto the companies that produce it. Seven states — including Maine, Oregon, Colorado, California, Maryland, and Washington — have enacted extended producer responsibility (EPR) laws for packaging, according to Proskauer's 2025 compliance guide. These laws require producers to register with a producer responsibility organization, report packaging volumes, and pay fees tied to material type and recyclability. Washington and Maryland's producer deadlines land in mid-2026. Illinois and Hawaii have ordered statewide needs assessments rather than full programs, with findings due by the end of 2026 and 2027 respectively. It's a patchwork, not a national standard, and most states still have no packaging EPR law at all. But the direction is consistent: less reliance on the assumption that recycling alone will solve a waste stream that's outgrowing it.

None of this points to one silver-bullet fix. Recycling still matters where it works, and it works better with cleaner sorting and steadier end markets. But a landfill system with a shrinking runway needs more than better sorting bins — it needs infrastructure that can convert what people actually throw away into something useful.
